General Terms and Conditions of the Center of Mental Excellence GmbH (hereinafter: CME) valid for: Further Education and Training (GTC)

By registering for the respective seminar, curriculum, module series, or other CME continuing education offerings, you agree to these General Terms and Conditions. CME concludes contracts and agreements based on these General Terms and Conditions as well as the advertisements for the respective curricula and seminars.

Anmeldung

Die Reservierung der Teilnehmerplätze erfolgt aufgrund der Reihenfolge der Anmeldung und Bezahlung. Die CME ist berechtigt, einzelne TeilnehmerInnen ohne Angabe von Gründen abzulehnen oder vom weiteren Besuch der Seminare/Fortbildungen aus wichtigem Grund auszuschließen.

Cancellations and Rebookings/Cancellation Conditions

Cancellations and rebookings must be made in writing and can be made by email or mail. Registration is binding and entails the conclusion of a contract. Cancellation fees apply for withdrawals after registration:
• Free cancellations are possible within 14 days of registration (right of withdrawal), unless the training course begins within 14 days of registration as agreed.
• After signing the contract, 50% of the participation fee is due.
• In the event of cancellations between 6 days before the start of the seminar and the day of the seminar, or in the event of non-attendance without cancellation, 100% of the seminar fee is due. The above-mentioned cancellation fees apply regardless of the reason for cancellation. The date of cancellation is the date the written cancellation is received by CME.

Right of withdrawal

For distance selling transactions, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date of registration (corresponding to the conclusion of the contract).
To exercise your right of withdrawal, you must notify us, Center of Mental Excellence GmbH, of your decision to withdraw from this contract by means of an unambiguous declaration (e.g., a letter sent by post, fax, or email). To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of Cancellation

If you cancel this contract, we will refund all payments we have received from you promptly and at the latest within 14 days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund. If you have requested that the service begin during the cancellation period, you must pay us an appropriate amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of your right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.

Seminar Cancellations and Changes

CME reserves the right to cancel the seminar or curriculum if the number of participants is too low or for other compelling reasons (e.g., speaker cancellation due to illness, if no substitute speaker is available at short notice). Participants will be informed immediately in these cases. Seminar fees already paid will be offset against any units already consumed. If parts of the fee (especially in the case of curricula) have not yet been consumed by attending events, a pro rata refund will be made or, upon request, the amount can be credited towards another seminar. Travel and/or accommodation costs or other expenses will not be reimbursed.
CME complies with legal regulations and quality standards. The company reserves the right to make changes to the content, duration, location, and date of seminars, as well as the price, without notice in the announcements and seminar programs.

Seminar Duration

Seminars will be held for the specified 45-minute units. Both speakers and participants must adhere to the specified seminar time.

Seminar Fee

Seminar fees are listed separately for each event. The listed fees include the cost of seminar materials and refreshments during breaks.

Payment Terms

The entire participation fee for the course, including all services within the announced scope, is due immediately upon receipt of the invoice. For organizational reasons, a place on the course can only be guaranteed after receipt of the participation fee. Please therefore transfer the invoice amount before the start of the course.
Unless otherwise agreed, all amounts are due upon receipt of the invoice. Discounts are not deductible. Partial payments are not permitted. Partial payments are not permitted. Partial payments are not prorated. Neither in the case of a later entry into the course nor in the case of a later entry into the course
A reduction in the participation fee is still possible in the event of cancellation or early withdrawal. In the event of late payment, we will charge all actual reminder and collection fees as well as 12% default interest. The place of jurisdiction and performance is Innsbruck. Only written agreements are valid. Verbal side agreements are not legally binding. CME employees are not authorized to make verbal contractual statements.

Tax Deductibility and Financial Support Options

Expenses for professional training can be claimed as business expenses (employees in the course of the employee tax assessment) or as expenses (self-employed persons in the course of the income tax return). CME seminars are professional training courses for subject matter experts; the corresponding invoices or payment receipts serve as proof for the tax office or accounting department.

Reference Certificates, Certificates, and Confirmations

We will send you the relevant certificate/completion certificate/certificate of completion for completed seminars/training courses at CME in printed form by mail and/or electronically. The prerequisite for participation is that the participation fee has been paid in full and that you meet the required completion criteria specified in the respective curriculum or event description (e.g., minimum attendance requirements, any required additional e-learning courses, final reports, etc.).

Data Protection

The privacy policy published on the CME website is deemed to have been agreed upon.
